These Terms of Service ("Terms") govern your use of the RhythmBreathe mobile application, operated by Lunar Pixel B.V. ("we", "our", or "us"). By downloading or using the app, you agree to these Terms.
1. Use of the App
RhythmBreathe is a personal wellness tool designed to guide mindful breathing practice. You must be at least 13 years old to use the app. You agree to use the app for lawful, personal purposes only. No account is required to use RhythmBreathe.
2. Health Disclaimer
RhythmBreathe provides guided breathing exercises for general wellness and is not a medical device or service. The app does not provide medical advice, diagnosis, or treatment. Breathing techniques are for general wellness only. Consult a qualified healthcare professional before use if you have respiratory conditions, heart conditions, anxiety disorders, or any other medical conditions. Stop using the app immediately if you feel dizzy, lightheaded, or unwell during a session.
3. No Account & Your Data
RhythmBreathe does not require an account. All session data and preferences are stored locally on your device. You retain full ownership and control of your data. No personal health data is transmitted to or stored on our servers. For full details, see our Privacy Policy.
4. Subscriptions & Purchases
RhythmBreathe offers a free tier and a premium subscription. Subscriptions are billed via Apple App Store or Google Play Store. Prices and billing periods are displayed at the time of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date. We do not issue refunds outside of platform refund policies.
5. Intellectual Property
All content, design, code, and branding within RhythmBreathe is owned by Lunar Pixel B.V. and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the app without our written permission.
6. Limitation of Liability
To the maximum extent permitted by law, Lunar Pixel B.V. is not liable for any indirect, incidental, or consequential damages arising from your use of RhythmBreathe. The app is provided "as is" without warranties of any kind. We are not responsible for any health effects resulting from use of the breathing exercises.
7. Termination
We reserve the right to suspend access to the app if you violate these Terms. Because no account is required, you may stop using the app at any time and delete all associated data by uninstalling it.
8. Governing Law
These Terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of the app after changes constitutes your acceptance of the updated Terms.
